Terms of Service

The agreement for booking FUNstoppable party entertainment.

These Terms of Service ("Terms") govern all party and entertainment services provided by **FUNstoppable** (referred to as "we," "us," or "our") to you, the client or booker ("you" or "Client"). By booking our services, you agree to be bound by these Terms.

1. Booking and Agreement

  • **Booking Confirmation:** A booking is only confirmed upon receipt of a completed booking form (online or physical) and, where applicable, a non-refundable **deposit** or the agreed-upon minimum booking fee.
  • **Confirmation Email:** We will send a confirmation email detailing the date, time, venue, and package agreed upon. This email constitutes the contract between us.
  • **Accuracy of Details:** The Client is responsible for ensuring all details provided (date, time, venue address, access details, etc.) are accurate at the time of booking.

2. Payment Terms

  • **Deposit:** All bookings require a **non-refundable deposit** to secure the date. The deposit amount will be specified in your quote.
  • **Balance Payment:** The outstanding balance must be paid in full no later than **7 days prior** to the date of the event, unless alternative arrangements have been formally agreed upon in writing.
  • **Failure to Pay:** If the balance is not received by the due date, we reserve the right to treat the booking as cancelled by the Client, resulting in the forfeiture of the deposit.

3. Cancellation Policy

All cancellations must be provided in writing (email) to FUNstoppable.

  • **Deposit:** The initial deposit is non-refundable in all circumstances.
  • **Cancellation 14 days or more before the event:** No further payment is required beyond the forfeited deposit.
  • **Cancellation between 7 and 13 days before the event:** 50% of the total agreed-upon fee is payable.
  • **Cancellation less than 7 days before the event:** The full agreed-upon fee is payable.

4. Venue and Safety Requirements

  • **Venue Responsibility:** The Client is responsible for securing the venue and ensuring it is available for the agreed-upon time, including setup and pack-down.
  • **Adequate Space & Power:** The Client must ensure the venue has adequate, safe, and easily accessible power sockets and enough space for the mobile disco setup and children's activities.
  • **Safe Environment:** The Client must ensure a safe and secure environment for our staff and equipment. We reserve the right to stop the performance immediately if we deem the environment unsafe, without refund.
  • **Supervision:** The Client is responsible for the overall behaviour and supervision of all children and attendees throughout the duration of the party.

5. Equipment, Liability, and Force Majeure

  • **Equipment Damage:** The Client will be liable for any wilful or careless damage caused to our equipment by any guest, adult or child, at the event.
  • **Liability Insurance:** FUNstoppable holds comprehensive Public Liability Insurance. Documentation is available upon request.
  • **Force Majeure (Unforeseen Circumstances):** In the highly unlikely event that we are unable to perform due to unforeseen circumstances beyond our control (e.g., severe illness, equipment failure, government restrictions, or travel issues), we will inform you immediately and attempt to find a suitable replacement entertainer or offer a full refund of all monies paid, including the deposit. We will not be liable for any further costs incurred by the Client.

6. Acceptance of Terms

By confirming a booking with FUNstoppable, you acknowledge that you have read, understood, and agree to these Terms of Service.
